He stressed that these occupation practices are a flagrant and gross violation of international law and resolutions of international legitimacy, foremost of which is Security Council Resolution No. 2334, noting that the settlement policy, whether building or expanding settlements, seizing lands or displacing Palestinians, is illegal, rejected and condemned.


Kamil called on the international community to take decisive positions to pressure Israel to stop its settlement practices and policies.

In addition to the fact that the land is the focus of the conflict, as is confirmed daily by what the occupying state and the herds of settlers are doing, the goal of this confiscation and confiscation is also to seize more Palestinian lands, whether directly or in various ways, such as claiming that it is a military maneuvers area, or setting up camps for the occupation army. We went through several stages, most notably the return of Arafat to Gaza after the Oslo agreement, which was agreed upon in secret. Haidar Abd al-Shafi leads the Palestinian movement, and his role has ended. He also resented that he was not informed of the secret negotiation, and considered the agreement a political stab at him, and in the estimation of almost everyone, he was right in that..


This talk is not intended to talk about the history of the issue at all, but rather about the steps that await us and what we are waiting for in the current stage that we are going through.


It is clear that the occupation is arrogant and expanding and does not care about any issue we have, and the only thorn in its throat is our demographic presence, our increasing numbers, and our steadfastness on our land despite all the difficulties and challenges.

For several well-known reasons, which strengthens the Palestinian presence, contrary to what they plan for, and one of the latest Israeli plans is the decision to return to the settlements that were evacuated by Sharon's decision to disengage from the West Bank, and to completely evacuate the Gaza Strip from settlements due to the lack of large land areas in it and the density of its Palestinian citizens.


They completely left the Gaza Strip, but at this stage, as in the past, they are expanding and establishing settlements and working to evacuate residents from their lands whenever possible, as they did in the town of Masafer Yatta in the Hebron governorate a few days ago, and preventing land owners in the northern West Bank from using the lands they own and surround Homesh settlement, which was evacuated and the settlers returned to it.


In light of the current situation, what are we waiting for, and what is waiting for the occupation? On the anniversary of Faisal’s passing, and in light of the great emptiness he left behind because he was not employed by anyone, nor did he derive his powers from anyone nor from an official position or position, but rather he was a natural leader and a lover of Jerusalem, who practiced his love for it with the pain of the lover, the eagerness of the beloved, and the asceticism of the retreat In the altar of lovers and the generosity of ascetics.


On the anniversary of Faisal's passing, a lot can be said, but here I will not cry and I will not mention the virtues and virtues of the deceased because he is alive in the conscience of Jerusalemites, and lamentation is not permissible for the living.


The martyr's friends and loved ones gathered, and although I am one of his closest friends and the one who loves him the most and misses his absence, I was unable to be with them for reasons beyond my control. They gathered in a modest number with pictures of Faisal and Palestinian flags to hang on the gate of the Orient House, to which Faisal was able to restore its Jerusalem national splendor, after it was transformed after 1967 into the Orient House Hotel. It was built by the Mufti of Jerusalem in the first half of the last century, Sheikh Ismail Musa Al-Husseini, and it witnessed the visits of international personalities such as the German Emperor Wilhelm, the Ethiopian Emperor Haile Selassie and others, and a funeral home for the late Sharif Hussein was opened in it.


Faisal was able to restore his status from a hotel to a lofty symbol of Palestinian patriotism and to make it a focal point for national action and a destination for political visitors. He hosted prime ministers, foreign ministers, senior officials and delegations from many countries of the world who used to come to the Orient House as the headquarters of the Palestine Liberation Organization in The heart of Jerusalem and a national address for Palestine, and I had the honor to accompany Faisal in these meetings or to act in his place as assigned by him when he was forced to be absent abroad, with a group of people from Jerusalem, the West Bank and the Gaza Strip representing all the colors of the Palestinian political spectrum. It was called the Orient House group led by Faisal Al-Husseini and at one time constituted a nightmare for some who feared that it would turn into an alternative leadership, although without exception it owed absolute loyalty to the leadership of the PLO, and categorically rejected all offers and temptations in return for deviating from the line of leadership in Tunisia.


Faisal's friends gathered to commemorate his memory, and perhaps they did not know that Faisal's image was still a nightmare for the occupation, as they had hardly gathered there until the occupation police raided them and took away the pictures and flags and dispersed them by force in front of the gate of the Orient House, which was closed by military order from the occupation since August 2001, i.e. after The departure of the martyr Faisal in less than three months. The closure orders regarding him and many Jerusalemite institutions closed by military orders are still renewed every six months, turning their closure into a fait accompli.


Taking pictures of Faisal and the Palestinian flags is part of the systematic Israeli policy to blockade Jerusalem, obliterate its national identity and prevent the emergence of any political activity in it. This Israeli policy was not limited to preventing the development of political life in Jerusalem, but extended to include cultural, sports, social and economic life and activities under the pretext that they are carried out in coordination with or with funding from the Palestinian Authority, and this is pure fabrication. The aim of this Israeli policy is to fight and tear apart the cultural, political, social and economic fabric of Jerusalem and to dissolve the Palestinian identity in it on the way to the familyization of society, institutions and life in Jerusalem.


There is no doubt that the siege that it imposed on Jerusalem since March 1993 and the apartheid wall that it erected around it since 2002 and completed its construction until 2006 have led, over time, to the separation of Jerusalem from its Palestinian depth in all respects, and gradually led to its transformation into what is more like Palestinian cities that It was occupied in 1948, and the gap between Jerusalem and the rest of the Palestinian territories is constantly deepening.


There is no doubt that the subject of social, cultural and political transformations in Jerusalem requires in-depth study. Despite the harsh Israeli policy and the fierce campaign against the Palestinian identity and presence in Jerusalem, and despite the isolation of the Palestinian Authority and its inability to be up to the challenges faced by the Jerusalemites, and their expectations that the Authority is unable to meet, Israel failed to kill the morale of the Jerusalemites or buy their belonging. The terms of reference of the Constitutional Court are extremely important for building a democratic nation based on public rights and freedoms and a nation based on integrity and transparency. We see the formation of the new Supreme Constitutional Court as an important factor for advancing the elections forward to reactivate the Legislative Council, especially since the court has jurisdiction stipulated in Article (24), including the exercise of all powers to consider and rule on the unconstitutionality of any legislation or act that is contrary to the constitution (in whole or in part). The Constitutional Court Law was amended twice: the first by Decree-Law No. (19) of 2017, and the second by Decree-Law No. (7) of 2019.


The Supreme Constitutional Court Law provides for the appointment of the president and members of the court for a non-renewable period of six years, taking into account the following: a. The court is formed of a president, a deputy, and no less than 7 judges. Three members are appointed to the court every two years from the date of the first formation of the court, and its decisions are taken by majority. Article (5) of the law states that whoever is appointed as a member of the court is required to meet the general conditions necessary to assume the judiciary in accordance with the provisions of the Judicial Authority Law, provided that his age is not less than (40) years, and he is among the following categories: 1. Current and former members of the Supreme Court Those who have spent at least 3 consecutive years in their jobs. 2. Current appeals judges who have spent 7 consecutive years in their positions. 3. Current or former law professors at Palestinian universities or recognized universities in Palestine who have spent at least 3 consecutive years as a professor, or an associate professor who has spent at least 6 consecutive years, or an assistant professor who has spent at least 9 consecutive years. 4. Lawyers who have practiced the legal profession for at least twenty consecutive years. 5. Members of the public prosecution who have spent at least fifteen consecutive years in the position of Chief Prosecutor or higher.


In view of the sensitivity of the jurisdiction, the formation of the Constitutional Court must consist of those who enjoy judicial and human rights competence and integrity, in order to ensure impartiality and impartiality, despite the seriousness of the results of appointments that may overthrow the most sacred legal and philosophical principles - the principle of democracy - but we note this time that the formation of the court does not exceed The provisions of the law regarding appointments in accordance with the provisions of Article (5) of the Supreme Constitutional Court Law, but the spirit of the law has been violated in some appointments; It is difficult to imagine challenging laws that had been drafted and passed by one of the members. This fact will impede fair or retrospective dealing with decisions and laws.


We would like to draw attention to the fact that the new formation excluded women in the judiciary, despite the honorable success stories in the various governorates of the country. Palestinian women have proven their superiority and steadfastness in this specialization, and how appropriate it would have been for Palestine if the formation was fair to half of the society according to the foundations of competence and not a quota or specific titles that brought together the members of the committee.

We would like to point out that Article (21) of the Constitutional Court Law of 2006 stated that the membership of judges ends when they reach the age of 70, and this was amended in Article (1) 10 of 2017 by deleting this age clause. Here we note the importance of experience and expertise built by the years and we stress Although it is not logical to end membership due to its abstract connection with age, but at the same time we hope to witness real governance in terms of appointments and to avoid rotating positions with regard to people with experience and long experience in serving the official sector and who have exceeded the general retirement age.


"Towards the rule of law and the supremacy of the constitution" is a saying adopted by the Supreme Constitutional Court as a vision. We hope that it will guide and follow it to reach the desired goal of embodying the principle of law to build the homeland and the citizen that Palestine deserves.
