واعتبر المجلس في بيان لها، أن ذلك يشكل قيودًا على ممارسة الحق في تشكيل الجمعيات وحرية عملها، وينطوي على إخلال بجوهر فكرة حرية العمل الأهلي ويتجاوز دور وزارة الداخلية الذي يحصره القانون في تسجيل الجمعيات.

وأوضح المجلس أن المادة (26) من القانون الأساسي المعدل لعام 2003م وتعديلاته، الحق في المشاركة السياسية بما في ذلك تشكيل النقابات والجمعيات والاتحادات والروابط والأندية والمؤسسات الشعبية وفقًا للقانون، فيما لم يخول القانون رقم (1) لسنة 2000م بشأن تشكيل الجمعيات الخيرية والهيئات الأهلية، أية جهة إجبار مؤسسات المجتمع المدني على التنسيق المسبق لتنفيذ أنشطتها خاصة ما يتعلق منها بقضايا بالمرأة، طالما أنها استوفت إجراءات تشكيلها وتسجيلها وفقًا لأحكام القانون.

وأشار إلى أن المادة (1) من قانون تشكيل الجمعيات، كفل حق الفلسطينيين في ممارسة النشاط الاجتماعي والثقافي والمهني والعلمي بحرية بما في ذلك الحق في تشكيل وتسيير الجمعيات والهيئات الأهلية، هذا بالإضافة لكون صلاحية إصدار قواعد عامة ومجردة تنطوي على تعديل بالإضافة للقانون الساري ليست من اختصاص دائرة المؤسسات بل هي اختصاص أصيل لمجلس الوزراء بموجب آلية التشريع اللائحي.

وأكد على أن قانون الجمعيات نظم الجانب الشكلي الإجرائي لها لا سيما قيدها في السجل العام، وضمان مراعاة تشكيلها وفق أحكامه دون التدخل في الجانب الموضوعي المتعلق بطبيعة الأنشطة نفسها، أما مسألة المتابعة فأناطها القانون بالوزارة المختصة، وبموجب قرار مسبب صادر عن الوزير في كل حالة، للتثبت من مراعاة أحكام القانون.

وبين أن المادة (10) التي تنص على التعاون والتنسيق فيما بين الوزارة والجمعيات للصالح العام، فإن مقصدها لا ينصرف إلى ما جاء في التعميم من تنسيق مسبق قد يتمخض عنه منع ممارسة العمل الأهلي.

وقال مجلس منظمات حقوق الإنسان الفلسطينية، إنه يرى أن هذا التعميم ينطوي على تمييز واضح ضد النساء، كونه خص المشاريع والأنشطة المتعلقة بالمرأة فقط، في تعارض واضح مع مبدأ المساواة وعدم التمييز، وهو ما يعتبر جريمة بحد ذاته.

وأكد على أن الحق في تشكيل الجمعيات وتسييرها، مكفول بموجب المعايير الدولية لحقوق الإنسان، ويُشكل أحد التزامات دولة فلسطين الدولية الناشئة عن انضمامها للعهد الدولي الخاص بالحقوق المدنية والسياسية بدون تحفظات، خاصة المادة (22) منه.

وجدد مطالبته بسرعة إلغاء التعميم رقم (4) لسنة 2021م، احترامًا للقانون ولمنظومة الحقوق والحريات العامة المكفولة بموجب القانون الأساسي الفلسطيني، ووفاءَ بالتزامات دولة فلسطين الناشئة عن انضمامها للاتفاقات الدولية لحقوق الإنسان.
