Introduction: The Palestinian Foreign Minister announced a few days ago that the Ministry of Foreign Affairs had submitted to the Prosecutor of the International Criminal Court in The Hague an integrated file related to the investigation conducted by the Palestinian Prosecutor in the case of the assassination of the martyr journalist Sherine Abu Aqleh, with all the evidence confirming the involvement of the occupying state and some of its officials in the murder. committing that crime.


In this article, I will try to shed light on the possibility of accepting the Public Prosecutor of the International Criminal Court to conduct an international investigation into the case directly, or by assigning a specialized international committee to do so, all in light of the legal rules related to the court and its terms of reference contained in the texts The Statute of the International Criminal Court, and the well-known positions of the Court’s Prosecutor, Karim Khan, especially since about a year has passed since he assumed his job at the Court without moving a finger in the cases brought against Israel by the State of Palestine several years ago after the pre-trial chamber decided The Pre-trial Chamber, that the court has jurisdiction to consider all serious crimes committed in the three regions of Palestine, namely: the West Bank, Gaza Strip, and East Jerusalem, since early 2021.


What can we expect from the Public Prosecutor of the Court regarding the procedures related to the case of the assassination of martyr Sherine Abu Aqleh:


We will shed light on the procedures that can be expected from the Public Prosecutor of the Court in response to the request submitted by the Palestinian Ministry of Foreign Affairs requesting the Public Prosecutor to start an investigation related to the murder of martyr Sherine Abu Aqleh.


Before starting to list what can be expected from the Public Prosecutor, we must refer to some legal provisions related to the court’s jurisdiction and how to act in such a situation, which are contained in the Court’s Statute and are beneficial to the Public Prosecutor and the Court, and these can be summarized as follows:


First: Perhaps the most important thing to start with is pointing out that Public Prosecutor Karim Khan assumed his job since the summer of last year 2021, as a public prosecutor of the Criminal Court, that is, since July 2021, but during that year he did not take any action in the cases submitted to the court. from the State of Palestine several years ago, rather ignoring it as if it did not exist, despite the fact that the former Public Prosecutor of the Court, Fatou Bensouda, had advanced quite a bit in those cases after obtaining the green light from the pre-trial circuit, as well as We referred to it above. There is no doubt that all of this can be considered an indication from which we can deduce what will be the position of Attorney General Karim Khan regarding the new request recently submitted by the Palestinian Ministry of Foreign Affairs.


Second: The preamble and first article of the Court’s statute provide for the following important legal rules:


1) The jurisdiction of the court is considered complementary to the jurisdiction of national courts.


2) The Court considers only the most serious crimes that are of international concern. (Articles 1 and 5 of the Basic Law)


3) The court only considers crimes attributed to natural persons and not to states or national, regional and international organizations. (Article 1 and Article 25 of the Statute of the Court)


4) The Court may decide that a case is inadmissible where a State is investigating or prosecuting the case, unless that State is genuinely unwilling or unable to undertake the investigation or prosecution. (paragraph 1 of Article 17)


5) The statute of the court stipulates that the trial does not take place without the presence of the accused in person before the court, and this may encourage Israel not to hand over the accused or the accused to the court, so that the trial does not take place. (Article 63 of the Basic Law).


Therefore, Israel can start a formal investigation claiming that it was late in the investigation until it is sure of the accuracy and validity of the facts and events, thus providing the public prosecutor with an argument and a reason to dismiss the case and refer the matter to Israel to start investigation work, even though the Israeli public prosecutor had officially announced Unwillingness to start an investigation, however, he had announced that he is refraining from the investigation at the present time, in implementation of a decision issued by the Israeli Supreme Court, as a way out to postpone the investigation, a position that is considered a circumvention of the provisions of the Statute of the Criminal Court, and an indication of cunning and deception.


Likewise, the public prosecutor can find other justifications, among those mentioned above, to refuse to open an investigation into the crime, for example, to consider that the killing of one citizen is not considered among the most serious crimes and the most threatening to international peace and security, according to the provisions of Articles 1 and 5 of the law. basic, mentioned above.


The public prosecutor can also claim that any case submitted to the court must include the name of the accused person, his rank, and the names of the official or officials who ordered him to commit the crime or incited him and helped him to commit it. Therefore, he can return the case to the Palestinian Authority, asking it to mention the aforementioned parties, claiming That he cannot investigate such a crime and that the State of Israel is competent to do so, bearing in mind that the State of Palestine, i.e. the state in whose territory the crime occurred, is primarily competent to conduct the investigation of this crime, but the State of Palestine can claim that its territory in which it occurred The acts constituting the crime, it is an occupied territory, and it is unable to conduct the investigation, so it requests that it be conducted by the Public Prosecutor or his representative, or the formation of an international committee to conduct it.


It should be noted here that the State of Palestine has the right to raise its inability to conduct a sound and reasonable investigation that would enable it to know the soldier who took it to know the soldier who fired the bullet that killed the martyr Sherine Abu Aqleh, because it has no control over the situation, and because Israel is an occupying country. The armed force controls the occupied territory and many elements of sovereignty in the territory, which makes the Palestinian Authority and the public prosecutor in Palestine unable to conduct an investigation with any Israeli soldier or employee, so it submits the aforementioned request to the court so that the public prosecutor takes the necessary measures for the investigation In the subject.

Conclusion:


For all the reasons mentioned above, I highly doubt that Attorney General Karim Khan will fulfill the Palestinian request. Rather, it is very likely that he will find one or more arguments to justify his refusal to answer the Palestinian request, and that he will transfer the request to Israel, asking it to conduct the investigation within a specified period ( two or three months, for example).


In addition, there is a possibility that the Palestinian Authority’s request would be rejected, claiming that the killing did not rise to its consideration as “one of the most serious crimes of international concern” as stipulated in Articles 1 and 5 of the Statute of the Court, which is the most likely possibility in my opinion, because of what is known The public prosecutor is biased in favor of some colonial countries, meaning that he is expected to act in accordance with the political pressure exerted on him by some major countries, such as the United States, or from some lobbies with international influence, and this is considered a great possibility.

فمن يتابع الاحداث والتطورات يلاحظ ان معظم الشهداء الذين استهدفتهم دولة الاحتلال ممثلة بقواتها العسكرية وقطعان المستوطنين هم من الاسرى المحررين.


فأمس على سبيل المثال استشهد شاب من يعبد متأثراً بجراحه التي أصيب بها قبل ايام لدى اقتحام قوات الاحتلال لبلدة يعبد، وهو الشهيد سميح عمارنة من الاسرى المحررين، كما استهدفت دولة الاحتلال قبل ايام معدودة ايضاً الصحفية وراسنة وهي ايضاً اسيرة محررة وكذلك الاسير المحرر ايمن محيسن من مخيم الدهيشة الى جانب الاسير المحرر داود الزبيدي من مخيم جنين، وغير الكثير من الاسرى المحررين الذين لا يتسع المجال لذكرهم في هذه العجالة.


وهذا يعني بكل وضوح ان جميع الاسرى المحررين هم هدف لقوات وقطعان المستوطنين، وكأن الأمر هو عبارة عن انتقام من هؤلاء الذين تم أسرهم ومن ثم تحررهم بعد ان امضوا سنوات في غياهب سجون الاحتلال.


وهذا الامر الذي يتطلب من الاسرى المحررين اتخاذ كافة اجراءات الحيطة والحذر، فقوات الاحتلال وقطعان المستوطنين وبالتعاون مع الجهات الامنية والمخابرات الاحتلالية تضعهم في مقدمة المستهدفين.


واذا ما أضفنا الى ذلك معانيات الاسرى داخل سجون الاحتلال جراء الاهمال الطبي وسوء الاحوال المعيشية داخل هذه السجون التي تفتقر لأبسط مقومات الحياة.


فهذه المعانيات وكذلك اعتداءات قوات السجون وعزل الاسرى وغيرها من الممارسات التي تتعارض مع القوانين والاعراف الدولية، ادت الى استشهاد عشرات الاسرى داخل وخارج السجون، خاصة الذين كانوا يعانون من امراض مزمنة وترفض سلطات الاحتلال تقديم العلاجات اللازمة لهم.


وأسطع دليل على ذلك رفض دولة الاحتلال اجراء عملية جراحية للأسيرة المصابة اسراء جعابيص، رغم التقارير الطبية التي تؤكد ان عدم اجراء عملية جراحية لها ستؤثر على حياتها وتعرضها للخطر.
فأي دولة هذه التي تستهدف الجرحى والمحررين والاسرى، ورغم ذلك فإن أسرانا ثابتين على مواقفهم، ولن تستطيع جميع اجراءات الاحتلال النيل من عزيمتهم وصمودهم وايمانهم بقضية شعبهم.

President's Health: Exposing the System's Crisis and Opportunities for its Reform

أبرزت الأيام الماضية التي ثار فيها الجدل وانشغل الرأي العام بإشاعات حول صحة الرئيس، مدى هشاشة النظام السياسي الفلسطيني وأزمته المركبة، وهي الحقيقة التي لا يمكن معالجتها بمجرد ظهور الرئيس في هذا الاجتماع أو ذاك. و إن دحض الإشاعات التي مررتها وسائل إعلام إسرائيلية حول وفاة الرئيس، إلا أنه لم يعالج تداعيات الجدل الناجم عن الأزمة الممتدة منذ أوسلو على الصعيدين الداخلي والسياسي.

إن اختزال النظام السياسي فقط بالرئيس، هو مؤشر خطير على ضعف وهشاشة النظام، وليس مؤشر لقوة الرئيس، ومدى قدرته على الإمساك بالحالة الفلسطينية المتهاوية، سيما في ظل انسداد أي أفق سياسي، وتراجع الاهتمام الدولي بالقضية الفلسطينية لدرجة ترك إسرائيل أن تطلق عنان سياستها العدوانية دون أية مساءلة جدية.

يبدو أن الحالة الفلسطينية لم تعد تحتمل ترف الاستمرار في مجرد التشخيص، ولا إضاعة المزيد من الوقت للاجتهاد الفكري في السيناريوهات المتوقعة. فنحن أمام احتمالين لا ثالث لهما، وهو أن نمتلك الشجاعة والإرادة الكافيتين لمعالجة أدران الأزمة ومسبباتها، أو نستسلم لهذه الأدران بأن تفتك بنا نحو مزيد من التفكك والضعف وحتى الاستجداء لتبرير الفشل دون بذل ما يكفي من الجهد لمعالجة أسبابه الحقيقية. إن انحراف النقاش العام وكأنه بين معسكرين متقابلين في مختلف القضايا، لا يعكس حقيقة ممكنات نهوض وأولويات الحالة الشعبية التي أبدعت بالتقاط ما يوحدها من قضايا جوهرية، إلا أن هذه الحالة، و كما كشفت الأزمة الأخيرة تعرضت لهزة وتراجع خطيرين، رغم استمرار قوات الاحتلال ومستوطنيه في استهداف حياة المواطنين وممتلكاتهم ومصادر رزقهم و قدرتهم على الصمود.

الأسئلة التي يجب أن توجه لطرفي الأزمة المهيمنيْن على المشهد الانقسامي بكل تداعياته هي: هل يستطيع أي طرف الانفراد بالمصير الوطني، وأن يحتكر القرار الوطني بهزيمة الطرف الآخر؟ بالتأكيد الجواب لا. وفي حال غاب الرئيس هل تعتقد حماس أنها تستطيع استكمال عملية اختطاف الشرعية التي للأسف وبفعل الانقسام أساساً، اختزلت بالرئيس وحده، فقط لمجرد أنها أي حماس، كانت قد حصلت عام 2006 على أغلبية مقاعد المجلس التشريعي، والذي للأسف تم حله كما تم إلغاء إعادة انتخابه، فأصبح أداة انقسام جديدة بدل أن يكون إحدى مرجعيات الوحدة والحوار الشعبي والبرلماني، ونحن بأمس الحاجة إليه؟ والجواب بالتأكيد أيضاً لا. والسؤال الأخير هل يعتقد من يقدمون أنفسهم لخلافة الرئيس أن بإمكانهم تورُّث الشرعية بمجرد أن يؤشر الرئيس نحو أحدهم، أو حتى لو توافقوا عليه، دون أن يتم ذلك عبر انتخابات عامة رئاسية وتشريعية أو من خلال توافق وطني شامل انتقالي لحين اجراء الانتخابات، وليس كامتداد تلقائي لحالة الانقسام؟ أيضاً الجواب ليس فقط لا، بل ربما تنتقل حالة الانقسام لمرحلة من الصراع متعدد الأوجه تكون فيه إسرائيل هي اللاعب الأكبر في تقرير شؤوننا الداخلية. وحتى لو افترضنا أن ذلك كله قد حصل بعكس ما نعتقد فهل هذا سيعالج جوهر المشكلة ببعديها السياسي الوطني في الصراع مع الاحتلال، والداخلي ومتطلبات اعادة بناء النظام السياسي على أسس ديمقراطية وجوهرها الانتصار لقضايا الناس و تعزيز قدرتهم على الصمود، واستنهاض كامل الطاقات الوطنية في معركة الحرية ؟!

مرة أخرى، إذا كان واقع الحال يشكل وصفات لاستمرار تغلغل الأدران، وليس تفتيتها أو استئصالها، فإن المنطق والمسؤولية يشيران إلى أن الخيارات المتاحة أمام الشعب الفلسطيني لكسر تلك الحلقة الجهنمية، تتمثل بأن نتوقع من الرئيس الذي نتمنى له كل الصحة والقوة للقيام بما هو مطلوب منه شخصياً، وفي مقدمة ذلك المبادرة لإنقاذ إرادة الفلسطينيين، وتوريثهم الحصانة الوطنية التي تُمكنهم من استعادة مصيرهم بأيديهم، وأن يتوافقوا تحت قيادته كرئيس لكل الشعب الفلسطيني ، وليس لمجرد فريق منه، على خطة طريق تنقله نحو بر الأمان في إطار الموسسات الوطنية الجامعة السياسية منها والحكومية، وذلك بالعودة للديمقراطية التوافقية، و لمبدأ الانتقال السلمي للسلطة عبر الانتخابات العامة الشاملة، والالتزام التام بنتائجها دون إقصاء أي طرف، وبما يُعيد للمؤسسات الوطنية هيبتها ومكانتها التمثيلية الجامعة، وبمشاركة الجميع بعيدًا عن الاقصاء والمحاصصة.

يبدو أن هذا الطريق ليس سالكاً بعد، بل يجري محاولة لوي عنقه من قبل الواهمين على طرفي الانقسام، الأمر الذي يفرض على كل الديمقراطيين والوطنيين التداعي من أجل التحضير لعقد مؤتمر وطني ينطلق من الإرادة الشعبية الشاملة، وأولويات الناس في مختلف تجمعات الشعب الفلسطيني، ليؤسس لمرحلة جديدة هدفها بناء كتلة شعبية، مرجعيتها الأساسية قضايا الإجماع الوطني والقانون الأساسي ومضمون وثيقة إعلان الاستقلال بكل عناوين العدالة الاجتماعية التقدمية التي تضمنتها، وصون الطابع الجبهوي والإئتلاف الشامل لمنظمة التحرير الفلسطينية باعتبارها الممثل الشرعي الوحيد لشعبنا وتطلعاته الوطنية وإنجازاته الديمقراطية، لتتحمل هذه الكتلة الشعبية مسؤوليتها نحو فتح الانسداد الذي أوجدته قوى الانقسام، وحماية النسيج المجتمعي والسلم الأهلي من خطر الانزلاق نحو العنف في معركة الصراع على السلطة. إن القدرة على المضي بهذا الطريق تستدعي من المستعدين للانخراط في هذا الجهد نبذ الفئوية والشخصانية، واحترام التنوع والتعددية، وبأن يتصدر هذه الرؤية قيادات شابة من مختلف الاتجاهات السياسية والقوى والفئات الاجتماعية و النقابات المهنية والحراكات الشعبية الناهضة، سيما من الشباب والنساء، وتلك المخلصة والمجربة، والقادرة على الإسهام في تحرير إرادة الناس.

لطالما جري الحديث عما هو مطلوب، ولكن السؤال الذي علينا أن نواجه أنفسنا به؛ لماذا لم يتحقق ذلك؟ وماهي العقبات التي حالت وتحول دون إطلاق هكذا عملية سياسية بنَّاءة، للانتقال من مجرد الكلام للعمل. هذا ما يجب أن يكون السؤال المركزي بهدف وضع إجابة ملموسة وعملية تفضي إلى بلورة خطة عمل جوهرها اعادة بناء الحركة الوطنية من أدنى إلى أعلى، دون إغفال دور الطليعة أو إدعاء عدم الحاجة له .قد يبدو ذلك عملية شاقة، فترميم حركة المجتمع واعادة بناء نظامه السياسي ليسا بالأمر السهل، سيما في ظل التحديات الكبرى التي تواجهنا وعلى رأسها اصرار حكومة الاحتلال والنظام السياسي في اسرائيل على طمس ومصادرة الحقوق الوطنية لشعبنا، إن لم يكن إلغاء الهوية الوطنية ذاتها، إلا أن عدم وضع كل المناكفات وحالة الشرذمة و التآكل الذاتي جانباً، سيلحق بقضية شعبنا أفدح الأضرار، والتي ستدفع الاجيال القادمة أثمانها ربما لعقود طويلة، والتاريخ حينها لن يرحم أحداً.

Following the vote on the law, Netanyahu said, in a video statement accompanied by the initiator of the bill, Knesset member Eli Cohen (Likud), "Today the Israeli flag won; we are bringing Israel back to the right." He added, "We passed the law with a majority." Overwhelming, the flag law, this is an important day for the State of Israel and for the future of the Jewish state.” Cohen said that the ratification of the law is “an important step to restore sovereignty. Earlier, the municipality of Ramat Gan lowered a banner that included the flags of Palestine and Israel, which were hung as a propaganda banner, and written on it in both Arabic and Hebrew that "our future is to live together", in a central location in the city overlooking the network of central "Ayalon" streets. The Israeli media caused an uproar following the hanging of the banner, which was installed against the background of the Knesset vote on the bill banning the raising of Palestinian flags in government-funded institutions, especially in educational institutions, in retaliation for raising the Palestinian flag at the universities of Beersheba and Tel Aviv. ..

Through raising it and commemorating the Nakba and other national activities, we aim to consolidate the idea that a just solution to the Palestinian cause will not be without recognizing the historical injustice that befell the Palestinian people in 1948, stressing that preventing the raising of the Palestinian flag is a denial of all international conventions and norms, and an infringement of freedom Expression, freedom of demonstration and freedom of thought. ‏


Commenting on the law, Representative Ayman Odeh, head of the Joint List, said, “This is the flag of the Palestinian people, raised by thousands of children on the anniversary of the Nakba every year, and this is what scares you. Arafat says that the manufacture of vehicles needs raw materials such as wood, nails, glue, and wood-cutting machines, so that the wooden panels are assembled with each other, after cutting the wood in proportion to its size, and fixing it with glue and nails, and then installing the wheels, and painting them with specific, recognized colors. .


He says that making these carts requires effort and time. In the past, it took a week to finish making one cart due to the manual work. Today, it takes no more than two days to make the cart, and this is due to the availability of modern machines that help him in the industry.
Arafat added that these carts are necessary for those who work as porters or for street vendors.


He points out that citizens' interest in purchasing vehicles is seasonal, but he continues to work on maintaining customers' vehicles on a permanent basis.


Arafat talks about several challenges he faces in his profession, foremost of which is the high price of wood, which drives up the prices of vehicles and the inability of customers to buy them, especially since they are either poor or have limited income.


Due to the decline in the demand for such vehicles, Arafat introduced making stairs, wooden windows, and coffins for the dead to his profession so that he could continue working and secure the necessities of life for his family.

Serbia extends its agreement to obtain Russian gas at reduced prices
